Terms of service
This website (hereinafter the "Site") is operated by ELEVATE Inc. (hereinafter the "Company"). By accessing this Site or purchasing products, you are deemed to use the "Services" provided by the Company and to agree to be bound by the following Terms of Service (hereinafter these "Terms"). Please read these Terms carefully before using the Site.
Article 1 (Application)
1. These Terms apply to all users of the Site, including visitors, customers, and merchants.
2. The various provisions, individual terms, privacy policy, and disclosures based on the Act on Specified Commercial Transactions that the Company publishes on the Site also constitute part of these Terms.
Article 2 (Conditions for Using the Online Store)
1. By agreeing to these Terms, users represent that they have reached the age of majority in their country or region of residence, or that they consent to the use of this Site by their minor dependents.
2. Products may not be used for illegal or improper purposes (such as resale or commercial use) without the Company's permission.
3. Transmitting destructive code such as computer viruses, or engaging in any act that interferes with the operation of the Site, is prohibited. In the event of a violation, use of the Services will be terminated immediately.
Article 3 (Membership Registration and Account Management)
1. Those who wish to register an account on the Site (hereinafter "membership registration") shall agree to these Terms and complete registration in accordance with the procedures established by the Company.
2. Members are obligated to promptly update their registration information whenever any changes occur.
3. Members may not lend, transfer, sell, or pledge their account or password to any third party. Members are solely responsible for any damages resulting from inadequate account management.
4. The Company may, at its discretion, refuse or cancel membership registration for individuals who have previously violated these Terms.
Article 4 (Changes to Services and Prices)
1. Product prices and specifications are subject to change without notice.
2. The Company reserves the right to modify or discontinue the Services (or any part or content thereof) at any time without notice.
3. The Company shall bear no liability whatsoever for any damages incurred by customers or third parties arising from changes to the Services, price changes, suspension, or discontinuation.
Article 5 (Product Purchases and Sales Contracts)
1. A sales contract for the relevant product is formed between the user and the Company at the time the user completes the order process on the Site and the Company issues an order confirmation notice (such as an automated email).
2. Notwithstanding the preceding paragraph, in the event of fraudulent or inappropriate conduct related to the use of the Site, or any violation of these Terms, the Company may cancel or terminate the sales contract or take other appropriate measures.
3. Customers warrant that the payment information provided at the time of purchase (credit card number, expiration date, email address, etc.) is accurate and current.
Article 6 (Shipping and Refusal of Delivery)
1. Conditions regarding shipping, orders, returns, and other aspects of purchases are governed by the separately established "Disclosures Based on the Act on Specified Commercial Transactions" and "Return and Refund Policy."
2. If a product is not received due to the customer's extended absence, refusal of delivery, or similar circumstances and is returned to the Company, the order shall be deemed canceled. In such cases, the customer shall bear the round-trip shipping fees, packaging material costs, warehouse handling fees, and any other actual losses and expenses incurred by the Company.
Article 7 (Prohibited Conduct)
Users shall not engage in any of the following acts when using the Site.
(1) Acts that violate laws and regulations or public order and morals
(2) Orders or purchases for the purpose of resale, auction listing, or other commercial gain
(3) Acts that infringe the intellectual property rights (including copyrights and trademark rights), portrait rights, privacy, or other rights of other users, third parties, or the Company
(4) Registering false information or impersonating a third party
(5) Acts that place an excessive load on the Site's systems, or hacking
(6) Any other acts the Company deems inappropriate
Article 8 (Disclaimer)
1. While the Company makes every effort to ensure the accuracy and completeness of the information on the Site, it does not fully guarantee such accuracy or completeness.
2. If a product is defective or differs from the item ordered, we will respond in accordance with the separately established "Return and Refund Policy," provided that you contact us within 30 days of the delivery date. Except as stated above, the Company bears no liability with respect to products, whether express or implied by law, for refunds, damages, price reductions, or similar remedies.
3. The Company shall bear no liability whatsoever for any damages incurred by users arising from the use of or inability to use the Site (including indirect, special, and consequential damages).
Article 9 (Handling of Personal Information)
Personal information submitted through the Site is handled appropriately in accordance with the Company's "Privacy Policy."
Article 10 (Changes to These Terms)
The Company reserves the right, at its sole discretion, to update, modify, or replace any part of these Terms at any time by posting the changes on the Site. Your continued use of the Site after changes are posted constitutes your agreement to those changes.
Article 11 (Governing Law and Jurisdiction)
1. These Terms shall be interpreted and applied in accordance with the laws of Japan.
2. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any disputes arising in connection with these Terms or the use of the Site.
